Welcome to MonsterWP.com (“Website”), a service provided by Monstrous Media Group (“Company,” “we,” “us,” or “our”). By accessing or using our website and purchasing any of our services, you agree to the following Terms of Use (“Agreement”).

If you do not agree to these Terms, do not use this Website or our services.

 

1. OVERVIEW OF SERVICES

MonsterWP provides subscription-based WordPress website development, hosting, maintenance, SEO, and digital marketing services (“Services”).

  • Our Services are provided on a subscription basis with recurring payments.
  • Customers (“Clients”) receive fully managed website services, but MonsterWP retains control over hosting, security, and backend access for maintenance and performance purposes.
  • Clients purchasing any MonsterWP plan agree that they are subscribing to an ongoing service.

 

2. ELIGIBILITY

By using our Website and purchasing our Services, you confirm that:

  • You are at least 18 years old or legally authorized to enter into this Agreement.
  • You are purchasing services for a business or personal use and not for resale.
  • You will provide accurate billing, contact, and account information.

 

3. SUBSCRIPTIONS & BILLING

3.1 Payment Terms

  • Recurring Billing: Services are billed automatically each billing cycle (monthly, quarterly, or annually, depending on your plan).
  • Billing Schedule: Billing begins immediately upon subscribing and continues on a monthly cycle until cancellation, regardless of project progress or delays.
  • Minimum Commitment: Clients agree to a minimum service term of 90 days (3 months) following website launch.

3.2 Delayed Launch & Billing Policy

  • MonsterWP aims to launch websites within 21 business days of receiving required content and approvals.
  • Client-caused delays do not affect billing cycles.
  • Billing will continue as scheduled, even if the website launch is delayed due to incomplete client content, lack of feedback, or other delays on the client’s part.
  • Failure to provide necessary content or approvals within 30 days of project start may result in MonsterWP proceeding with launch based on the best available information.

3.3 Cancellation Policy & Early Termination

  • Clients may not cancel within the first 90 days after the website is launched.
  • After the 90-day period, clients may cancel at any time by submitting a cancellation request before the next billing cycle.
  • Early termination before 90 days requires payment for the full term, and no prorated refunds will be issued.

 

4. CANCELLATIONS & REFUNDS

4.1 Cancellation Policy

  • Clients may cancel their subscription after the 90-day minimum term by logging into their account and submitting a cancellation request.
  • Cancellations must be made before the next billing cycle to avoid further charges.

4.2 Refund Policy

  • 14-Day Satisfaction Guarantee: If you are unsatisfied within the first 14 days of your initial subscription, you may request a full refund.
  • No refunds will be issued after the first 14 days.
  • No refunds for partial months of service after a billing cycle has started.

 

5. CLIENT RESPONSIBILITIES

Clients agree to:

  • Provide accurate and timely information necessary for website setup, SEO, and marketing.
  • Not engage in illegal, fraudulent, or harmful activities using MonsterWP services.
  • Not request or attempt to access, modify, or remove core website files without prior approval from MonsterWP.

Failure to comply may result in suspension or termination of services without refund.

 

6. OWNERSHIP & ACCESS RIGHTS

6.1 Website Ownership

  • Clients own all website content (text, images, branding) that they provide.
  • MonsterWP retains ownership of proprietary website frameworks, themes, and hosting infrastructure.

6.2 Hosting & Access Limitations

  • Websites built on MonsterWP are hosted and maintained by MonsterWP as part of the service.
  • Clients do not receive backend access to WordPress hosting or cPanel to maintain security and performance standards.
  • If a client cancels their subscription, they may request a website migration to another hosting provider for a one-time transfer fee.

 

7. SERVICE LIMITATIONS & LIABILITY

7.1 Project Timelines & Client Responsibilities

  • MonsterWP will make every effort to launch websites within 21 business days.
  • If a client fails to provide necessary assets (text, images, approvals, or logins) within 30 days of subscription start, MonsterWP reserves the right to launch a default website using the best available information and placeholder content.
  • Any revisions after the website is launched will follow standard support & update policies as part of the subscription.

7.2 Service Downtime & Maintenance

  • MonsterWP guarantees 99.9% uptime but is not liable for temporary downtime due to maintenance, third-party service issues, or cyberattacks.
  • Scheduled maintenance will be communicated at least 24 hours in advance when possible.

7.3 Limitation of Liability

  • MonsterWP is not liable for lost revenue, data loss, or indirect damages resulting from website outages, SEO fluctuations, or security breaches.
  • Our maximum liability under this Agreement is limited to the amount paid by the Client in the last 3 months of service.

7.4 Third-Party Integrations

  • We are not responsible for third-party software, plugins, or services integrated into a Client’s website (e.g., payment gateways, marketing tools).
  • Clients using third-party plugins do so at their own risk.

 

8. MODIFICATIONS TO TERMS

MonsterWP reserves the right to update these Terms at any time. If changes are significant, we will provide at least 30 days’ notice via email or website notification. Continued use of our services after the notice period constitutes acceptance of the new Terms.

 

9. TERMINATION

MonsterWP may suspend or terminate services if:

  • A Client fails to pay after multiple attempts.
  • A Client violates these Terms or engages in fraudulent or illegal activities.
  • We determine that continuing service for a Client poses a risk to our business operations.

 

10. GOVERNING LAW & DISPUTES

  • These Terms are governed by the laws of the State of [Your State], United States.
  • Any disputes shall be resolved through binding arbitration in [Your State], except where prohibited by law.
